Recently the Chief Justice dealt with a rule nisi for a writ of habeas corpus which had been obtained by Mr Thomas Short of Coburg, calling upon Elizabeth Lewins, of Rosslyn-street, West Melbourne, to show cause why she should not give up the custody of David Glen Henderson, aged 15, her son by a former husband. It appears that Mr Short was appointed guardian of the boy by order of Mr. Justice Hood, made in 1898. Last year the respondent took the boy out of the guardian's custody. The boy, it appears, is entitled to £1,248 on attaining 21 years of age, under the intestacy of his grandmother Catherine Short, deceased. Under section 83 of the Marriage Act respondent made application that she should be allowed to have custody of the boy in lieu of the guardian, and, as Mr. Short assented, his Honour made an order accordingly, the-guardian to be discharged from his office on payment of £15 arrears of money due.
