Imposition.
A lad of 18 years of age, named David Herbert Joseph, was charged with unlawfully obtaining a motor cycle by means of valueless cheques. Inspector Noble prosecuted and Mr. McFarlane defended. By consent the case was altered to one of imposing on Frank Campbell with intent to defraud.
Frank Campbell, cycle builder, deposed that accused came to him with another man, who introduced him. Accused bought a new motor cycle from witness, gave a cheque for £40 on the Bank of Australasia Melbourne, and took the machine away. Witness had since recovered the cycle in good condition. The cheque was signed in a fictitious name. Formal evidence having been given of the dishonour of the cheque, there being no account at the bank in the name given. Detective Napthine deposed to the arrest of the accused, who admitted giving the valueless cheque. Witness recovered the machine, defendant showing him where it was.
This being all the evidence, Mr. McFarlane asked that the accused be given
another chance. The lad intended to take the cycle back to Mr. Campbell. His parents were most respectable, and his father would enter into a bond for his good behaviour. The Bench administered a caution and did not want to send accused to gaol. He had brought disgrace on himself, and worse still, on his parents. He would be remanded for 6 months, and if his conduct were good up till then, he would not be punished, but if he misbehaved, he would then be punished for the present offence. Accused's father then entered into a bond for 6 months, and the defendant left the court.
